Terms of Service

Please read these Terms carefully. They form a binding agreement between you and Bizsys Consulting LLC ("Bizsys Consulting LLC", "we", "us", or "our"). Section 16 contains a binding individual arbitration agreement and a class-action waiver that affect how disputes are resolved. By using Tableside, you agree to these Terms.
1. About Tableside
Tableside is web-based online booking software for appointment-based businesses. It lets a business ("Business") publish a booking page, manage staff, services, availability and appointments, and send appointment-related notifications to the people who book with them.
Tableside serves two kinds of users. A Business (its owner and staff) registers an account and subscribes to use Tableside to run its booking page. A Customer books an appointment on a Business's booking page. Tableside provides the software only. The massage, wellness, or other services you book are provided by the Business, not by Tableside. We are not a party to, and are not responsible for, the services a Business provides, its prices, or its cancellation, refund, health, or safety practices.
2. Definitions
- Services — the Tableside websites, booking pages, dashboards, and related software and features.
- Business (also "Provider") — a business, and its authorized owners and staff, that uses Tableside to accept bookings.
- Customer — a person who books, reschedules, or cancels an appointment through a Business's booking page.
- Booking Page — the public page (on a Tableside subdomain or a Business's custom domain) where a Business's Customers book appointments.
- Booking — an appointment a Customer reserves through a Booking Page.
- Account — the credentialed login a Business owner or staff member creates to manage the Services.
- Content — information you submit through the Services, such as booking details, appointment notes, business and service descriptions, and branding.
3. Eligibility & acceptance
You must be at least 18 years old and able to form a binding contract to use the Services. By accessing or using the Services — whether as a Business or a Customer — you confirm that you meet these requirements and agree to these Terms. If you use the Services on behalf of a Business, you represent that you are authorized to bind that Business to these Terms.
The Services are intended for use in the United States.
4. Business accounts
To use Tableside to accept bookings, a Business must create an Account and provide accurate, current, and complete information, and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your Account. Notify us promptly at support@booktableside.com if you suspect unauthorized use.
As a Business, you are solely responsible for:
- your services, prices, availability, staff, and the accuracy of the information on your Booking Page;
- your appointment, cancellation, no-show, refund, health, and safety policies, and for performing the services you offer;
- how you configure and use messaging (including SMS and email) and any analytics or advertising tags you add, in compliance with applicable law; and
- your relationship with, and the personal information of, your own Customers, for which you act as the controller of that data (see our Privacy Policy).
5. Subscriptions, billing & cancellation
Tableside is offered to Businesses on a subscription basis. Paid plans, features, and prices are described on our pricing page and may change. Subscription billing is processed by our payment processor, Stripe; Bizsys Consulting LLC does not store your full payment card details.
- Billing cycle: subscriptions renew automatically each billing period (for example, monthly or annually) until cancelled.
- Trials: where a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel before it ends.
- Cancellation: you may cancel from your billing settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
- Refunds: except where required by law, fees are non-refundable and partial periods are not prorated.
- Changes: we may change plans, features, or prices on a prospective basis; we will provide notice of material changes as required by law.
Customers do not pay Tableside. Any payment for the services a Customer books is arranged directly between the Customer and the Business.
6. Booking appointments (Customers)
When you book as a Customer, you agree to provide accurate contact information (such as your name, phone number, and email) so the Business can prepare for and contact you about your appointment. Prices, availability, services, staff assignment, and cancellation policies are set and controlled by the Business, not by Tableside.
- A Booking is a request to reserve a time with the Business. The Business is responsible for honoring, rescheduling, or cancelling appointments.
- You can cancel an appointment using the link provided in your confirmation or reminder message, or by contacting the Business.
- Any cancellation fees, deposits, or no-show policies are set and enforced by the Business. Tableside does not collect these and is not responsible for disputes about them.
7. SMS/text messaging program
If you opt in when booking, you agree to receive automated appointment reminder text messages and related booking notifications from the Business you booked with, sent via Tableside, at the mobile number you provide. Opting in is not required to make a booking.
- Message types: appointment reminders and booking-related notifications (for example, confirmations or changes to an appointment you made).
- Message frequency: varies based on your appointments — typically one reminder per booked appointment.
- Cost: message and data rates may apply, depending on your mobile carrier and plan.
- Cancel an appointment: each reminder text includes a link to cancel that specific appointment.
- Opt-out: reply STOP at any time to unsubscribe. You may receive a final confirmation message.
- Help: reply HELP for help, or contact us at support@booktableside.com.
- Consent: consent to receive text messages is not a condition of booking or of purchasing any goods or services.
Carriers are not liable for delayed or undelivered messages, and message delivery is subject to effective transmission from your wireless service provider. See our Privacy Policy for how mobile information is handled — it is never sold or shared with third parties for their own marketing.
8. Email & other notifications
We (and Businesses, through Tableside) may send you service messages about your Account or Bookings, such as confirmations, reminders, changes, receipts of a subscription, security notices, and legally required notices. Because these are necessary to provide the Services, you generally cannot opt out of them while you use the Services. Marketing emails, where sent, include an unsubscribe link.
9. Reviews & Google integrations
Tableside does not host or publish customer reviews. If a Business enables review requests, Tableside may email a Customer a link to leave a review on the Business's Google profile after an appointment. Any review you submit is governed by Google's terms and privacy policy, and the review is published on and controlled by Google — not by Tableside. A Business may also add its own Google Analytics or Google Ads tags to its Booking Page; see our Privacy Policy.
10. Content you provide
You retain ownership of the Content you submit. You grant Bizsys Consulting LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your Content solely to operate and provide the Services (for example, to show a Business's services on its Booking Page, or to deliver a booking to the Business). You are responsible for your Content and represent that you have the rights to provide it and that it does not violate any law or third-party right. We may remove Content that we believe violates these Terms or applicable law.
11. Acceptable use
You agree not to:
- use the Services for any unlawful, harmful, deceptive, or fraudulent purpose, or to send spam or unsolicited messages;
- submit false, misleading, infringing, defamatory, or otherwise unlawful Content, or make bookings you do not intend to honor;
- upload viruses or malicious code, or attempt to disrupt, overload, or gain unauthorized access to the Services, other accounts, or our systems;
- use bots, scrapers, or other automated means to access or collect data from the Services without our permission;
- reverse engineer, decompile, or attempt to extract the source code of the Services, except to the extent permitted by law; or
- misuse another user's information, or use the Services in violation of any applicable law, including telemarketing, messaging, and consumer-protection laws.
12. Intellectual property
The Services, including all software, text, graphics, and the "Tableside" name and logo, are owned by Bizsys Consulting LLC or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services. We reserve all rights not expressly granted. You may not copy, modify, distribute, sell, or create derivative works from the Services except as permitted by these Terms.
13. Third-party services
The Services rely on trusted third parties to function — including Stripe (subscription payments), Twilio (SMS delivery), our email delivery provider, and Google (analytics and, where a Business configures them, advertising tags). Your use of those features may also be subject to the third party's terms and privacy policy. We are not responsible for third-party services, and their availability may affect the Services.
14. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any information will always be accurate, complete, or current. Bizsys Consulting LLC does not provide the services a Customer books; those are provided solely by the Business, and Bizsys Consulting LLC makes no warranty as to their quality, safety, legality, or outcome.
15. Limitation of liability & indemnification
To the maximum extent permitted by law, Bizsys Consulting LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, goodwill, or business, arising out of or relating to the Services, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid Bizsys Consulting LLC in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to defend, indemnify, and hold harmless Bizsys Consulting LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your Content, your violation of these Terms, or — for Businesses — your services, policies, messaging, and handling of your Customers' information.
16. Dispute resolution & arbitration
Please read this section carefully — it affects your legal rights. Before starting a formal proceeding, you agree to first try to resolve any dispute informally by contacting us at support@booktableside.com and allowing 60 days to resolve it.
If we cannot resolve a dispute informally, you and Bizsys Consulting LLC agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for intellectual-property misuse. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class-action waiver: disputes will be arbitrated only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. Jury-trial waiver: to the extent a dispute proceeds in court, you and Bizsys Consulting LLC waive any right to a jury trial. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section still applies. This section survives termination of these Terms.
17. Term, suspension & termination
These Terms apply while you use the Services. A Business may stop using the Services by cancelling its subscription; a Customer may stop at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Services or other users. On termination, the rights granted to you end, though provisions that by their nature should survive (including Sections 10, 12, 14–16, and 19) will survive.
18. Changes to the services & these Terms
We may modify, add, or discontinue features of the Services at any time. We may also update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Terms.
19. General terms
These Terms, together with our Privacy Policy, are the entire agreement between you and Bizsys Consulting LLC regarding the Services and are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws rules. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
